Planning Agreement – DA 8/2022

Planning agreements must be publicly notified and made available for public inspection before they can be entered into.

Council is exhibiting the attached Planning Agreement (draft PA) that will apply to the property currently known as 65 Hope Street Warialda.

This draft PA is associated with the development approval (DA 8/2022) for the subdivision of 65 Hope Street Warialda into seven (7) urban dwelling allotments of various sizes.

The objective, nature and effect of the draft PA is for the developer to provide stormwater management, via kerb and guttering (with associated access points/driveways), to that section of Hope Street that will be associated with the development (as approved under DA 8/2022).

The draft PA, an Explanatory Note and other supporting documentation are on public exhibition on Council’s Website from Wednesday 25 September 2024 at 8.00am to 5.00pm on Tuesday 22 October 2024.

Interested persons are invited to inspect the draft PA, Explanatory Note and other supporting documentation.  Written submissions concerning the provisions in the draft PA may be made to Council throughout the abovementioned exhibition period.

Submissions should reference “65 Hope Street Warialda Draft PA” and can be posted to Gwydir Shire Council, Locked Bag 5, Bingara NSW 2404 or emailed to mail@gwydir.nsw.gov.au

The last day for the receipt of submissions is Tuesday 22 October 2024 at close of business (5.00pm).

Please note confidentiality is not available to persons who make a submission.  The details of the submission may be included in a Council report or forwarded to the proponent/developer where it may assist in the resolution of issues relating to the development.  Information may also be released in accordance with Government Information (Public Access) Act 2009 and on Council’s website.

Any comments about the draft PA may contain information that is personal information.  The inclusion of personal information with your submission is voluntary.  However, if not provided Council will not be able to contact you about the draft PA.  For your protection, Council recommends that you do not include defamatory comments in your submission.
